PlotForge Terms of Service

1. Introduction and Acceptance

Welcome to PlotForge, an AI-powered creative writing platform operated by Loophead Labs LLC ("Company," "we," "us," or "our"), a Delaware limited liability company with its principal place of business at 8 The Green, Suite B, Dover, DE 19901.

By accessing or using PlotForge (the "Service") at https://plotforge.app, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

PlotForge is a web-based platform that provides AI-assisted tools for creative writers, including but not limited to:

Story Outline Generation: AI-powered generation of narrative structures, plot beats, and chapter outlines
Character Development: Tools for creating, managing, and developing fictional characters with AI assistance
Chapter Drafting: AI-assisted prose generation and scene composition
Scene Surgery: AI-powered revision and editing suggestions for existing scenes
Consistency Checking: Automated analysis to identify narrative inconsistencies
Emotional Arc Visualization: Tools to track and visualize character emotional journeys
Export Features: Ability to export manuscripts, outlines, and character profiles in multiple formats

The Service uses third-party AI language models to assist with creative writing tasks. AI-generated content is provided as suggestions and creative assistance, not as final work product.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your account credentials
Accept responsibility for all activities that occur under your account

3.2 Account Security

You are responsible for safeguarding your password and for all activities conducted through your account. You agree to:

Not share your account credentials with any third party
Notify us immediately at contact@plotforge.app of any unauthorized use of your account
Not use another person's account without permission

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:

Violation of these Terms
Fraudulent or illegal activity
Abuse of the Service or other users
Non-payment of subscription fees

4. Subscription Plans and Billing

4.1 Subscription Tiers

PlotForge offers multiple subscription tiers:

Free Tier: Limited access to core features with usage restrictions
Starter Tier: Enhanced access with increased usage limits and access to standard AI models
Pro Tier: Full access to all features, advanced AI models, and highest usage limits

4.2 Payment and Billing

Subscription fees are billed in advance on a recurring basis (monthly or annually)
Payment processing is handled securely through Stripe, Inc.
All fees are non-refundable except as required by law or as explicitly stated in these Terms
We reserve the right to change subscription prices with 30 days' advance notice

4.3 Coin-Based Credits

PlotForge uses a coin-based credit system for AI operations:

Each subscription tier includes a monthly coin allotment
Coins are consumed when using AI features (outline generation, drafting, etc.)
Additional coins may be purchased as needed
Unused coins do not roll over to subsequent billing periods unless explicitly stated

4.4 Free Trial

We may offer free trial periods for new users. By signing up for a trial:

You authorize us to charge your payment method when the trial ends
You may cancel before the trial ends to avoid charges
Each user is entitled to one free trial per subscription tier

4.5 Cancellation and Refunds

You may cancel your subscription at any time through your account settings
Cancellations take effect at the end of the current billing period
30-day money-back guarantee is not absolute; excessive use or completion of a book may void eligibility
Upon cancellation, you retain access to paid features until the end of your billing period

5. User Content and Intellectual Property

5.1 Your Content Ownership

You retain all ownership rights to the creative content you create using PlotForge ("User Content"), including:

Stories, manuscripts, and narrative works
Character profiles and descriptions
Outlines and plot structures
Any other original creative material you input or generate

5.2 License to PlotForge

By using the Service, you grant Loophead Labs LLC a limited, worldwide, non-exclusive, royalty-free license to:

Store, process, and display your User Content to provide the Service
Use aggregated, anonymized data derived from User Content to improve the Service and AI models
Generate AI-assisted suggestions and content based on your inputs

This license terminates when you delete your content or close your account, except for content that has been shared with others or is required for legal or operational purposes.

5.3 AI-Generated Content

Content generated by AI features ("AI Content") is provided as creative assistance. You acknowledge that:

AI Content may not be unique and similar content may be generated for other users
AI Content may require substantial editing and human creativity to become a finished work
You are responsible for reviewing, editing, and taking ownership of any AI Content you use
We make no representations about the originality, accuracy, or quality of AI Content

5.4 Prohibited Content

You agree not to create, upload, or share content that:

Infringes on intellectual property rights of others
Contains hate speech, harassment, or discriminatory content
Depicts or promotes illegal activities
Contains malware, viruses, or malicious code
Violates the privacy or publicity rights of others
Is sexually explicit involving minors

We reserve the right to remove any content that violates these Terms.

5.5 PlotForge Intellectual Property

The Service itself, including all software, designs, text, graphics, interfaces, and trademarks, is owned by Loophead Labs LLC and is protected by copyright, trademark, and other intellectual property laws. You may not:

Copy, modify, or reverse engineer any part of the Service
Remove or alter any copyright, trademark, or proprietary notices
Use our trademarks without prior written permission

6. Acceptable Use Policy

You agree to use PlotForge only for lawful purposes and in accordance with these Terms. You agree NOT to:

Use the Service to violate any local, state, national, or international law
Impersonate any person or entity or misrepresent your affiliation
Engage in any automated use of the system (scraping, bots, etc.) without permission
Interfere with or disrupt the Service or servers
Attempt to gain unauthorized access to any part of the Service
Upload or transmit viruses or malicious code
Collect or harvest personal information about other users
Use the Service to generate spam or unsolicited communications
Abuse AI features to generate harmful, illegal, or inappropriate content
Share or resell access to the Service without authorization

Violation of this Acceptable Use Policy may result in immediate account termination.

7. AI Model Usage and Limitations

7.1 AI Model Access

Different subscription tiers have access to different AI models:

Free and Starter tiers use cost-optimized AI models
Pro tier includes access to advanced AI models including Claude Sonnet

7.2 Usage Limitations

AI features are subject to:

Rate limits to prevent abuse
Coin balance requirements
Fair use policies to ensure service availability for all users

7.3 No Guarantees

We do not guarantee:

The accuracy, quality, or originality of AI-generated content
Continuous availability of specific AI models
That AI-generated content will meet your expectations or requirements

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, available at https://plotforge.app/privacy.

By using the Service, you consent to our collection and use of personal information as described in the Privacy Policy.

9. Third-Party Services

PlotForge integrates with third-party services including:

Stripe for payment processing
AI API Providers for language model access
Cloud Storage Providers for data storage

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

10. Disclaimers and Limitations of Liability

10.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content

10.2 No Guarantee of Service Availability

We do not guarantee that:

The Service will be uninterrupted, secure, or error-free
Defects will be corrected
The Service is free of viruses or harmful components
Results obtained from using the Service will be accurate or reliable

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOOPHEAD LABS LLC SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Loss of creative work or manuscripts
Damages resulting from unauthorized access to your account

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10.4 User Responsibility

You are solely responsible for:

Backing up your creative work and content
Any consequences of publishing or sharing AI-generated content
Ensuring AI-generated content does not infringe on others' rights
Complying with all applicable laws in your use of the Service

11. Indemnification

You agree to indemnify, defend, and hold harmless Loophead Labs LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the Service
Your User Content
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

12. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes:

We will update the "Last Updated" date at the top of these Terms
We will notify you via email or through the Service
Continued use of the Service after changes constitutes acceptance of the new Terms

If you do not agree to modified Terms, you must stop using the Service and may cancel your account.

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

Canceling your subscription through account settings

13.2 Termination by Us

We may terminate or suspend your account immediately, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of fees
At our sole discretion for any reason

13.3 Effect of Termination

Upon termination:

Your right to use the Service ceases immediately
We may delete your User Content after a reasonable grace period
Sections of these Terms that by their nature should survive termination shall remain in effect

13.4 Data Export

Before termination, you should export your content using our export features. We are not obligated to retain or provide access to your content after termination.

14. Dispute Resolution and Governing Law

14.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

14.2 Arbitration Agreement

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

YOU AGREE TO WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

14.3 Exceptions to Arbitration

Either party may seek injunctive relief in court for:

Intellectual property infringement
Unauthorized access to the Service
Violation of the Acceptable Use Policy

14.4 Jurisdiction

If arbitration is not enforceable, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware.

15. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Loophead Labs LLC regarding the Service.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

15.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms at any time without notice.

15.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government action.

15.6 Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the Service.

15.7 U.S. Government Users

If you are a U.S. government entity, the Service is a "Commercial Item" as defined in FAR 2.101 and is subject to these commercial terms.

BY CREATING AN ACCOUNT AND USING PLOTFORGE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE.
